House Arrest vs Bail vs Detention in Russia
A Russian court chooses between three main pre-trial measures when an investigator asks to restrict a suspect: detention in a remand facility, house arrest at a fixed address, or bail paid into a court deposit. Detention is the harshest and the one investigators request most often. House arrest keeps the person at home under strict rules. Bail leaves the person free but puts money at risk if the conditions are broken.
Attorney Elena Petrova represents suspects and their families at restraint hearings and on appeal against these rulings.
How Each Measure Works in Practice
All three are listed in the Criminal Procedure Code alongside milder options such as a written undertaking not to leave and a ban on certain actions. The court must explain why a softer measure would not be enough.
Detention means placement in a pre-trial detention centre. House arrest confines the person to a residence, with an electronic bracelet and limits on visitors, phone calls and the internet. Bail is a sum paid by the suspect or a third party; the law sets a minimum depending on the gravity of the charge.
Restrictions and Obligations Compared
| Measure | Freedom of movement | Contact and communication | Main risk for the accused |
|---|---|---|---|
| Detention | None | Visits and letters only with permission | Loss of work, health strain |
| House arrest | Home only, walks if the court allows | Court may ban phone, internet, visitors | Transfer to custody for any breach |
| Bail | Free, may need permission to travel | Usually no limits | Forfeiture of the deposit |
A breach of house arrest or bail terms almost always leads to a new hearing on detention.
Duration and Extensions
Detention and house arrest are granted for up to two months at first. The investigator then asks for extensions. During the investigation the total term depends on the gravity of the charge and can reach eighteen months for especially grave crimes. After the case goes to court, the trial court decides on the measure again.
Time spent in custody or at home is counted toward a later prison sentence, but at different rates. A day of house arrest counts for less than a day of detention.
What Court Statistics Show
The Judicial Department of the Supreme Court publishes yearly figures on sudrf.ru. They show a steady pattern: courts grant most detention requests, while bail remains rare. House arrest is used more often than bail but far less often than detention.
For a defence lawyer this means one thing. The hearing is won on concrete facts, not on general appeals to the presumption of innocence.
Special Rules for Entrepreneurs
The Code restricts detention for certain economic crimes linked to business activity. If the charge concerns fraud or similar offences committed in running a company, custody is allowed only in narrow cases. Investigators sometimes reclassify the charge to avoid this limit. The defence should check the wording of the charge closely.
Building the Defence at the Hearing
The investigator must prove a real risk that the person will flee, pressure witnesses or continue offending. The defence answers with documents:
- proof of permanent residence and title or a lease for the address;
- employment records and family obligations;
- medical certificates, if health rules out custody;
- consent of the owner of the flat where house arrest will be served;
- evidence of the source of bail money.
Petrova offers the court a specific alternative: an address, a bail amount, a guarantor. A concrete proposal is harder to reject than a bare request for release.
Appeal and Later Review
A detention ruling can be appealed within a short period to the higher court. Each extension hearing is a new chance to argue for house arrest or bail. The passage of time weakens the risk arguments once witnesses have been questioned and evidence has been seized.
