Property Division: Agreement vs Court

Spouses in Russia can divide joint property by a notarised agreement or by a lawsuit. An agreement is faster, keeps the terms private and lets the parties split assets in any proportion. A court divides property by the rules of the Family Code, usually in equal shares, and the process can take many months when real estate, business shares or foreign assets are involved. Choosing the route is a question of how much the spouses still agree on.

Attorney Elena Petrova advises spouses living in Russia and abroad, including those with assets in several countries.

The Notarial Agreement

Since 2016 an agreement on dividing joint property must be certified by a notary. A simple written paper signed by the spouses no longer works. The agreement can be signed during the marriage, at divorce or after it.

It lists each asset and who receives it, and may include compensation payments. A marriage contract is a separate tool: it sets the property regime for the future, while the division agreement deals with what already exists. Both need a notary.

The Court Route

Without agreement, one spouse files a claim. Depending on the value of the claim, a justice of the peace or a district court hears it. Division can be claimed together with divorce or separately.

The court identifies joint property, excludes personal property such as gifts and inheritance, and assigns assets. Where a thing cannot be split, one spouse receives it and pays the other compensation. The limitation period for a claim is three years from the moment a spouse learned that their right was breached, not from the date of divorce.

What Each Route Costs

The notary charges a fee tied to the value of the property, plus technical services. Registration of new owners in the state register adds its own duty.

In court, the claimant pays state duty on the claim value. Expert valuation of flats, cars and company shares is often required, and each expert report is paid separately. Lawyer fees rise with every hearing and with appeals.

Who Controls the Result

In an agreement the spouses decide everything, including unequal shares and the fate of debts toward each other. Creditors, however, are not bound by the spouses' deal on joint debts.

In court, control passes to the judge. The court may depart from equal shares only for serious reasons, such as the interests of minor children or one spouse wasting family money.

A Middle Path: Settlement in Court

Spouses who start in court can still settle. A settlement agreement approved by the judge ends the case and has the force of a judgment. This works when negotiation needs the pressure of a hearing date.

Preparing Either Way

Petrova first builds a full list of assets with title documents, dates of acquisition and sources of money. Foreign accounts, crypto assets and business shares are checked separately. Then she recommends whether a draft agreement has a real chance or whether a claim should go ahead.
