Debt Collection in Russia: FAQ

Recovering a debt in Russia usually runs through three steps: a written demand (pretenziya), a court judgment, and enforcement by bailiffs or banks. If the debtor is insolvent, bankruptcy becomes the fourth route. Attorney Elena Petrova answers fifteen questions creditors ask before starting.

The Pre-Trial Demand

Is a pretenziya mandatory?

In commercial disputes, yes. The creditor sends it and may file a claim in the arbitrazh court thirty days later, unless the contract sets another period.

What should the demand include?

The amount, its basis, a calculation of interest and penalties, a payment deadline and bank details.

How should it be delivered?

By registered mail with a list of contents, or by a method set in the contract. Proof of delivery is needed for court.

Going to Court

Which court handles the claim?

Arbitrazh courts deal with debts between businesses. District courts and justices of the peace deal with claims against individuals.

Is there a faster route than a full lawsuit?

Undisputed debts under written documents below a statutory threshold can be recovered by a court order without a hearing. The debtor may cancel it by objecting.

Timelines and Limitation

StagePeriodComment
Limitation period3 yearsSuspended during the pre-trial demand
Arbitrazh first instance3 monthsSimplified procedure is faster
Appeal1 monthFrom the full decision
Writ validity3 yearsRenewed after return by bailiffs

Can interest be added?

Yes. Contractual penalties or statutory interest under the Civil Code accrue until full payment.

Enforcement

What do bailiffs do?

Freeze accounts, seize and sell property, restrict travel abroad for individuals and search for assets. The creditor may file motions and complain about inaction to the senior bailiff or the court.

Can I go directly to the bank?

Yes. A writ can be sent to the debtor's bank, which must debit the account. The creditor attaches an application with its own bank details, and the bank executes the writ as funds arrive.

What if the debtor has no assets?

The bailiff closes the case, and the writ returns to the creditor. It can be resubmitted later.

Bankruptcy of the Debtor

When can a creditor file for bankruptcy?

When the debt exceeds a statutory threshold and has not been paid for three months. For companies, the creditor must first publish a notice of intent.

What does bankruptcy give the creditor?

Control over the process and the chance to challenge suspicious transactions and hold directors liable.

Costs

Who pays legal costs?

The losing debtor reimburses the state fee and reasonable legal fees. Courts reduce excessive claims, so the creditor should keep the service agreement, acts of work and payment records.

Is it worth suing an insolvent debtor?

First check the debtor's assets, open enforcement cases and court records. If nothing can be recovered, a claim against the director or controlling persons may be more realistic than a judgment against an empty company.

Foreign Creditors

Can a foreign company recover a debt in Russia?

Yes. It needs apostilled corporate documents, a power of attorney and certified translations.

Is a foreign judgment enforceable?

Only with a treaty or on the basis of reciprocity, after recognition by a Russian court.
