Divorce in Russia: FAQ
A marriage in Russia is dissolved either at the civil registry office (ZAGS) or in court. The registry route is open when both spouses agree and have no minor children; any dispute or a child under 18 sends the case to court. Attorney Elena Petrova answers fifteen questions that foreign and mixed couples raise most often.
Grounds for Divorce
Do I need to prove fault?
No. Russian family law does not require fault. The court only establishes that family life cannot continue.
Can my spouse block the divorce?
Not permanently. A court may postpone the case for up to three months to allow reconciliation, then grants the divorce if one spouse insists.
Are there times when a husband cannot file?
Yes. Without the wife's consent, a husband cannot start divorce during her pregnancy or within a year after the child's birth.
Registry Office or Court
| Situation | Where | Typical duration |
|---|---|---|
| Mutual consent, no minor children | ZAGS | One month after application |
| Spouse missing or incapacitated | ZAGS | Upon application with court act |
| Minor children or objection | Justice of the peace | One to three months |
| Property dispute joined | District court | Several months |
Can I divorce without coming to Russia?
Yes. An attorney acting under a power of attorney can represent you in court, and ZAGS accepts a notarised application in certain cases.
Dividing Property
What property is shared?
Everything acquired during the marriage, whoever paid or holds title, is presumed joint and divided equally. Gifts, inheritance and pre-marital assets are personal.
Can a prenuptial agreement change this?
Yes. A notarised marriage contract may set any regime, but it cannot leave a spouse in an extremely unfavourable position.
Is there a deadline to claim property?
Three years, counted from when a spouse learned that his or her share was violated, not from the divorce date.
Children and Custody
With whom will the child live?
If parents disagree, the court decides based on the child's interests, living conditions and attachment. A child of ten or older is heard.
Can one parent take the child abroad?
Russia is party to the 1980 Hague Convention on child abduction. Wrongful removal may lead to a return order.
Alimony
How is child support calculated?
As a share of income: a quarter for one child, a third for two, and half for three or more. A fixed sum can be set when income is irregular.
Can a former spouse receive support?
In limited cases: a wife during pregnancy and for three years after the child's birth, a spouse caring for a disabled child, or a spouse who is disabled and in need.
What if the payer lives abroad?
A Russian judgment on alimony may be enforced abroad under treaties, and bailiffs can restrict the debtor's exit from Russia while arrears remain.
International Marriages
Which law applies to a mixed couple?
Russian courts apply Russian law to a divorce heard in Russia. Property abroad may fall under the law of its location.
Will a Russian divorce be recognised abroad?
Most countries recognise it, sometimes after a separate procedure. A foreign divorce also often needs recognition in Russia.
Starting the Process
What documents are needed?
The marriage certificate, children's birth certificates, proof of income and property papers. Foreign documents require an apostille and a certified translation.
