Advokat vs Jurist: What's the Difference?

In Russia, anyone with legal training can call themselves a jurist and sell legal services. An advokat is different: a lawyer admitted to a regional bar chamber after an exam, listed in an official register and bound by a professional code. For a client abroad, the distinction decides who may defend you in a criminal case, whether your conversations are protected and how the fee agreement must look.

Attorney Elena Petrova is a Russian advokat working with clients in California and other countries. Below is where the law draws the line.

Legal Status and Admission to the Bar

The advokat's status comes from Federal Law 63-FZ "On Advocacy and the Bar". A candidate needs a higher legal education and at least two years of work in the legal profession. The candidate then passes a qualification exam before the bar chamber, takes an oath and becomes a member of that chamber.

A jurist has no special status. The title covers in-house counsel, consultants and sole practitioners. No chamber supervises them.

How to Verify Who You Are Hiring

An advokat has a registry number in the regional register of advocates, kept by the territorial office of the Ministry of Justice. The number and the chamber's name appear on the advokat's ID. You can ask for both and check them on the Ministry's register or the chamber's website.

For a jurist, you can check only a diploma and court records of past cases.

Access to Criminal Cases

This is the sharpest difference. Under the Criminal Procedure Code, the defence counsel of a suspect or accused person is an advokat. A relative or another person may be admitted alongside the advokat by the court, but not in place of one at the investigation stage.

In civil and arbitrazh courts, the rules are softer. Since the 2019 procedural reform, a representative must hold a higher legal education or a law degree, with exceptions for magistrate and district courts in civil cases. So a qualified jurist can argue a contract or property dispute, but cannot take over a criminal defence.

Privilege and Protection of Client Information

Everything an advokat learns while helping a client is covered by advocate secrecy. The advokat cannot be questioned as a witness about those circumstances. Searches of an advokat's office or files require a court order and additional safeguards set by the procedural code.

A jurist is bound only by a contractual confidentiality clause. If an investigator summons a jurist as a witness, that person has no statutory right to refuse on the ground of professional secrecy.

Fees and the Agreement With the Client

An advokat works under a written agreement on legal assistance. The law lists its essential terms: the subject of the assignment, the fee and payment procedure, and the advokat's liability. Contingency fees in court cases are restricted by the rules of professional ethics.

A jurist signs an ordinary service contract. On both sides, prices are set by agreement and depend on the case.

Which One You Need

For a criminal matter, a search, questioning by investigators or detention of a relative in Russia, you need an advokat from the first day. For contract drafting or a routine civil claim, a jurist may be enough. If the dispute could turn criminal, starting with an advokat avoids changing counsel midway.
