Divorce in Russia: The Complete Guide

Russian law offers two ways to end a marriage: through the civil registry office, known as ZAGS, or through a court. The choice depends on whether both spouses agree and whether they have minor children. The rules are in the Family Code, and property is divided under a regime of community property that often surprises foreign spouses.

Attorney Elena Petrova handles divorces for clients in Russia and abroad, including marriages with a foreign element. This guide covers the routes, the property questions, children, timing and international issues.

Choosing Between ZAGS and Court

ZAGS dissolves a marriage when both spouses consent and have no common minor children. They file a joint application, pay the state fee and receive the divorce certificate after one month. One spouse alone may use ZAGS if the other is declared missing, incapacitated or sentenced to imprisonment for more than three years.

All other cases go to court. A magistrate hears the divorce when there is no dispute about children. A district court hears it when parents disagree about where children will live. A husband cannot start a divorce without the wife's consent during her pregnancy and for one year after the birth of a child.

Dividing Marital Property

Property acquired during the marriage belongs to both spouses in equal shares, regardless of whose name is on the title or who earned the money. This covers real estate, cars, bank deposits, business shares and income. Property owned before the marriage, received as a gift or by inheritance stays personal.

A marriage contract can change these rules. Spouses may also sign a notarized agreement on division. Without one, the court divides the assets and may depart from equal shares in the interests of children. The limitation period for division is three years, counted from the day a spouse learned that the other violated their rights.

Children After Divorce

Parents keep equal rights after the divorce. They may agree on residence, contact and support in writing. If they cannot, the court decides, taking into account the conclusion of the guardianship authority and, from the age of ten, the child's own opinion.

Child support is fixed as a share of the parent's income: one quarter for one child, one third for two, half for three or more. The court may set a fixed sum when income is irregular or received abroad.

How Long a Divorce Takes

RouteEarliest completionWhat can extend it
ZAGS by mutual consentOne month after filingMissed appointment
Magistrate, no child disputeOne month after filingReconciliation period up to three months
District court with child disputeSeveral monthsExpert reports, guardianship review
AppealPlus two to four monthsFiling within one month of the decision

The marriage ends on the day the court decision enters into force. The decision is then sent to ZAGS, where the divorce is registered.

Divorces With a Foreign Element

When one spouse is a foreign citizen or the couple lives abroad, Russian courts may still have jurisdiction. Divorce between a Russian citizen and a foreigner in Russia follows Russian law. A foreign spouse may participate through a representative with a notarized power of attorney.

A Russian decision may need recognition abroad, and a foreign divorce may need recognition in Russia. Russia recognizes a foreign divorce between its citizens and foreigners when it complies with the law of the state where it was granted. Documents need an apostille and a certified translation.

Mistakes That Cost Time or Money

Spouses often move assets out of reach before filing. An early request for interim measures, such as a ban on selling a flat, protects the future division. Another error is to ignore business shares and foreign accounts, which are also joint property.
