When the Tax Authority Suspends a Bank Account in Russia: Article 76 Explained

The Russian tax authority can suspend operations on a taxpayer's bank accounts without a court order, and Article 76 of the Tax Code lists the situations. The most common are enforcement of a decision to collect tax debt and a failure to file a return twenty days after the deadline. In debt cases the bank blocks spending only up to the negative balance of the unified tax account, and in filing cases the suspension must be cancelled no later than one day after the missing document is submitted.

For a company with foreign owners or a foreign entrepreneur registered in Russia, an account blocked on a Friday can stop payroll and supplier payments the same day. This guide explains the grounds, the limit set by the unified tax account, which payments still go through, how fast the suspension is lifted and how to challenge it.

The Grounds in Article 76

Article 76 names several situations. The first is the enforcement of a decision on the collection of tax debt: the authority suspends spending from the accounts of an organisation, including digital ruble and electronic money accounts, to secure payment. For organisations, the suspension covers the negative balance of the unified tax account.

The second is a late tax return. If a return is overdue by twenty days from the deadline, the head or deputy head of the tax authority may decide to suspend the account, and the suspension may be applied until the document is filed. The commentary on the Article still mentions an older ten-day period, which shows the need to check the current text.

The third is a late calculation by a tax agent: calculations of personal income tax or insurance contributions overdue by twenty days. A further ground arises if the company fails, within ten business days after the deadline, to send the tax authority an electronic receipt confirming that it received a request for documents, a request for explanations or a summons sent through telecommunication channels.

The Unified Tax Account Limit

In debt cases the bank blocks spending only up to the amount of the negative balance of the unified tax account, which is recalculated every day on the basis of the debt register. The block lasts until the balance becomes positive or zero.

This means that a company with a tax debt of a known size should not lose access to all of its money. If the bank blocks more than the negative balance, the company should send the bank and the tax authority a written objection with the balance data and ask for the correction.

For foreign currency accounts, the negative balance is converted into rubles at the Bank of Russia rate on the date the suspension started. A company holding funds in several currencies should check the calculation for each account.

What Still Goes Through

The Article protects certain payments even during the suspension. Payments of taxes, fees and insurance contributions, and transfers to the budget, remain possible. Payments with a higher priority under civil law, as the Article defines them, are also unaffected.

The practical consequence is that a company may pay the tax debt itself from the blocked account, which is the fastest way to end the suspension. It should do so with a clear payment purpose and keep the order and the bank's confirmation.

Payroll and supplier payments do not take precedence over tax payments in the civil-law order of priority, so they are generally blocked. A company should plan for this by keeping reserves on accounts in other banks only if the law allows, and not by moving money to avoid the block, which can be treated as a violation.

How Fast the Block Is Lifted

Article 76 sets a one-day period for cancellation. If the return or calculation is filed, the tax authority must cancel the suspension no later than the next day. If the grounds were a debt, the bank resumes spending no later than one day after the debt register shows a positive or zero balance or after the authority receives proof of payment.

In practice, delays arise when the filing is made late in the day, when the electronic receipt is not recorded or when the bank does not receive the notice. The company should keep the confirmation of the filing, call the inspection and the bank and send a written request to lift the suspension.

If bankruptcy proceedings start, insolvency law changes how tax debts are collected, and the fate of the suspension should then be checked under that law and the current text of Article 76.

Challenging an Unlawful Suspension

If the suspension was imposed without grounds, for example when the return was filed on time or the debt was already paid, the company may appeal to the higher tax authority and to the arbitrazh court. The appeal states the date of the decision, the grounds claimed by the authority and the documents that show the opposite.

The claim for losses caused by an unlawful suspension is possible, with proof: late payments, penalties from counterparties and lost contracts. The claim must be connected by evidence to the suspension.

The company should file the appeal quickly and ask for interim measures to lift the block while the case is heard. The court looks at the harm that the block causes.

Prevention for Companies With Foreign Management

Calendar every filing date. Appoint someone in Russia to receive and answer electronic notices from the tax authority, and set up the electronic document exchange with an operator. Check the unified tax account balance regularly. Keep proof of every filing.

A foreign director who is rarely in Russia should give a trusted accountant or representative the powers needed to file and to communicate with the authority. A power of attorney should be current and cover the tax matters.

Reserve funds for taxes, because the quickest way to unblock an account is payment of the debt.

Practical Steps If the Account Is Blocked

Obtain the decision and the bank's notice. Identify the ground. If it is a filing, submit the missing document at once and send proof. If it is a debt, check the unified account and pay what is due. Ask the bank in writing to confirm the exact amount of the block. Appeal if the grounds are absent.
