Russian vs Foreign Court for Your Dispute

If your counterparty and its assets are in Russia, a Russian court is usually the practical forum, because a foreign judgment may never be enforced there. A court in California, London or another country makes sense when the assets sit abroad or when the contract already names that forum and the other side has something to lose outside Russia.

Attorney Elena Petrova helps clients abroad weigh the forum question before a claim is filed. The choice decides cost, timing and whether the decision turns into money.

Will the Judgment Be Enforced Where the Assets Are

A Russian court recognises a foreign judgment only where an international treaty or reciprocity allows it. Russia and the United States have no treaty on mutual enforcement of court decisions. Russian courts have at times accepted reciprocity arguments, but the outcome is hard to predict and each case is argued from scratch.

Arbitral awards are a different story. Russia is a party to the 1958 New York Convention, so an award of an international arbitration tribunal is generally easier to enforce in Russia than a foreign state court judgment. Grounds for refusal still exist, including public policy, and they are raised often.

How Sanctions Changed Jurisdiction

The Arbitrazh Procedure Code now gives Russian arbitrazh courts exclusive jurisdiction over many disputes involving sanctioned Russian parties. Such a party can ask a Russian court to stop foreign proceedings or to take the case over, even where the contract names a foreign forum. A foreign decision obtained in breach of that rule risks refusal of recognition in Russia.

Before choosing a foreign forum, check whether either side, its owners or its bank are on a sanctions list. That single fact can decide the question.

Comparing Costs on Both Sides

State fees in Russian courts are calculated from the claim amount and are usually modest compared with Western litigation. Legal fees and expert costs are also lower in most cases. Recovery of legal costs from the losing side is possible, though courts often reduce the amount claimed.

Litigation in the United States or England involves discovery, depositions and hourly billing that can quickly exceed the value of a mid-size claim. Add translation of Russian documents and witness travel.

Speed From Filing to Payment

A commercial case in a Russian arbitrazh court often passes the first instance within months. Appeals follow quickly, and the decision enters into force after the appeal. Foreign litigation may take longer, and a separate recognition case in Russia adds another round with its own appeals.

Delay matters because assets move. A debtor may transfer property while a foreign case drags on.

Neutrality and Home Advantage

Foreign clients sometimes fear bias in a Russian court. In ordinary commercial disputes Russian judges mostly rely on documents and apply the contract. Risk grows when the counterparty is linked to the state or when the case touches politically sensitive assets. In those situations a neutral arbitration seat may be worth the extra cost, provided enforcement is realistic.

A Framework for Choosing the Forum

The first answer often settles the rest. Work through these questions in order:

Send the contract, the correspondence and whatever you know about the other side's property. Elena Petrova will review the dispute clause, check the counterparty in Russian registers and outline which forum gives a decision you can enforce.
